These Terms of Service ("Terms") govern your access to and use of the SceneArk mobile application (the "Application") provided by the Developer ("we," "us," or "our"). By downloading, accessing, or using the Application, you agree to be bound by these Terms. If you do not agree, please do not use the Application.

1. Use of the Application

The Application is provided as a freemium service. Basic features are available for free, while premium features require a paid subscription. You must be at least 13 years old to use the Application.

2. Subscriptions and Payments

Premium features are available through in-app subscriptions purchased via the Apple App Store or Google Play. All billing, payments, refunds, and cancellations are handled exclusively by Apple or Google according to their respective terms and conditions. We do not store or process your payment information.

3. User Conduct and Fair Usage

You agree not to use the Application for any unlawful purpose or attempt to disrupt the Application's features or limitations.

Premium subscriptions provide unlimited queries for normal personal use, subject to a Fair Use Policy cap of 1,000 searches per billing cycle. We reserve the right to monitor usage and implement reasonable measures (such as temporary throttling, rate limits, suspension, or termination of access) to prevent abuse, excessive automated queries, or activity that could unreasonably impact the service or incur excessive costs. Such actions may occur without refund, at our sole discretion.

4. Intellectual Property

The Application and its original content (excluding third-party movie, TV, and search data) are owned by us or our licensors. You are granted a limited, non-transferable, non-exclusive license to use the Application for personal, non-commercial purposes.

6. Use of Artificial Intelligence

The Application uses Artificial Intelligence (AI) technologies, specifically Google Gemini 3 Flash, to provide certain features. By using the Application, you acknowledge and agree that AI and search APIs (such as Serper) may process your queries to deliver responses.

7. Disclaimer and Limitation of Liability

The Application is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Application.
